Mead Johnson, Maker of Enfamil, Loses Multi-Million Dollar False Advertising Case Against Store-Bran

GORDONSVILLE, VA., December 2 , 2009PBM Products, LLC, a leading infant formula company that supplies store-brand infant formulas to Walmart, Sam's Club, Target, Kroger, Walgreens, and other retailers, has received a favorable jury verdict and a $13.5 million damages award in its false advertising lawsuit against Mead Johnson & Co., the operating subsidiary of Mead Johnson Nutrition Company (NYSE: MJN) (“Mead Johnson”), the makers of the national-brand Enfamil® LIPIL® Infant Formula. Mead Johnson is 83 percent-owned by Bristol-Myers Squibb.

PBM’s lawsuit claimed that Mead Johnson engaged in false and misleading campaigns against PBM’s competing store-brand of infant formulas, suggesting they do not provide the same nutrition as Mead Johnson’s brands. PBM’s store-brand infant formulas cost up to 50 percent less than Enfamil® LIPIL®. The $13.5 million in damages awarded by the jury in the United States District Court for the Eastern District of Virginia is one of the largest damages awards ever for a false advertising case.

“This decision by a jury of the people confirms that Mead Johnson’s ads have been false in suggesting that there is a nutritional difference between our store-brand formula products and their products, when in fact the only major difference is price,” said PBM CEO Paul B. Manning. “Despite Mead Johnson’s scare tactics, parents are assured that PBM’s formula products are as high quality and nutritious as Mead Johnson’s.”

U.S. District Court Judge James R. Spencer issued his written rulings yesterday following the November 10th jury verdict. Judge Spencer’s written rulings permanently enjoined Mead Johnson from making any false statements concerning PBM's infant formula, including the claims Mead Johnson previously made in Enfamil advertising that "It may be tempting to try a less expensive store brand, but only Enfamil LIPIL is clinically proven to improve brain and eye development," and "there are plenty of other ways to save on baby expenses without cutting back on nutrition." The Court also ordered Mead Johnson to retrieve from the public domain all advertising or promotional materials containing these or any other false claims about PBM's store brand infant formula.

The nutritional supplements under examination in the case are two fats, DHA (docosahexaenoic acid) and ARA (arachidonic acid), which Mead Johnson calls “LIPIL®” solely for marketing purposes and touts as promoting infant brain and eye development. PBM’s claim focused on Mead Johnson’s direct mailing to more than 1.6 million parents of an alarming blurry picture of a child’s cartoon duck next to a clear picture of the same image which suggested that anything other than the Enfamil LIPIL® blend of ingredients is inferior and will result in poor eye and brain development. Other parts of the false advertising campaign consist of statements that only Enfamil LIPIL has been proven to confer visual and mental benefits on infants, and store-brand formulas are a “cut-back in nutrition” compared to Enfamil.

PBM successfully argued that these advertisements were false and misleading especially since PBM store- brand infant formulas have the same nutrients at the same levels as Enfamil. PBM infant formulas are formulated to contain DHA and ARA, and are sourced from the same supplier in amounts which equal or exceed the DHA and ARA in Mead Johnson’s Enfamil LIPIL®.

This decision marks the third time PBM Products has sued Mead Johnson for false advertising claims. On the prior occasions Mead Johnson admitted that it made false claims about PBM’s products. It is also the first false advertising case to focus on the issue of DHA and ARA nutritional ingredients in formula, which were introduced into the market in 2003 and have become a staple in recent years by many brands as key components for infant development.

“This jury verdict should send a significant and clear message to Mead Johnson about the way it conducts marketing and advertising for its brands,” said Manning. “This lawsuit also demonstrates our complete commitment to defending our products and the valuable brands of our retail partners.”

“As a parent and supporter of children’s medical research, I take a personal responsibility in assuring our customers that the products we produce are healthy and nutritionally equivalent to brand names like Enfamil® LIPIL®. It is important, especially now, for parents to know that there are lower priced yet highly nutritious store-brand formulas that will provide the same benefit to their children as any national brand name formula product,” Manning added.

The U.S. infant formula market is estimated at $3.4 billion and the global market is estimated at $7.9 billion.

Making sushi

hmmm....was looking back at the pictures and saw some interesting pics, thought wanna share with you all.

for the record, I feel very hungry now after looking at the pictures.

When i was back at home, my sister suddenly felt "very generous" (i know she is going to kill me for this) and made us sushi. well, of course simple one lar....but quite nice though. :D

when saw her doing it, felt quite easy, but i don't think i am gonna try doing it. :D she just put the rice, then applied the mayonnaise, then put the ingredients, then rolled it. after that will become the sushi rolls already...simple right?

after cutting the sushi rolls, then became like this. of course not like the sushi in the Sushi King, but then good enough lo i think, considering who is making it (just joking just joking. :D)

start to miss home cook food already. LOL.

Article Directory

I love reading a lot, since young books have been my most loyal companion most of the time. My interests ranging from horror, science fiction, suspense, adventure, battle to fantasy. Sometimes I read comics as well if you count that as part of reading activities. But then as I grow up, I find the books I wish to read and buy have become more and more expensive. So, sometimes I would rather rent or borrow the books rather to buy them.

Nevertheless, with the wide usage of internet nowadays, it has been an easy task to try to search for something to read on the net. I always get to download free books or sometimes articles from the internet. There are several websites to go to though, normally I would go to general article directory to search for the articles that I am interested in. Sometimes, you would find a lot of interesting and unique articles in just one article directory, but there are cases whereby only several unique articles could be found as most of the articles are repetitive.

So, one of the best ways to determine the quality of the directory is to look at their Submission Guidelines. If the rules are strict enough, most likely the quality of the articles you can find are very good as well. So, all the best and start reading today!

Pusing Prawn mee

Went to Pusing the other day for lunch and had their famous prawn mee. My friend ordered the curry mee with pork slices. they were all good!

the famous prawn mee. very big portion, the prawns were quite fresh and tasted good also. and most important, they gave 5 prawns for RM6. it sounds cheap to me though. hhuhu...

Yummy....i think i will go again one day. hehe...or maybe Tanjung Tualang? :D

Prescriptions

I don’t really have the habit of taking pills or medicine since young. Even if I was down with flu or fever, I always refused to take any form of medicine to help me get better. I don’t know why, but I felt that medicine would make me feel weaker and sort of addicted to them.

But then, as I grow older and got more exposed to the information about the medicines, I find out that suitable amount of drugs can help to boost our immune system and help us to recover faster from any diseases. Some drug will help to curb or lighten the sickness or diseases.

Besides, as I was doing my readings on the internet, I found out that there are some differences between brand-name prescriptions and generic prescriptions. When a company develops a new drug, the company will receive a patent that lasts for 20 years. So other companies are unable to sell the drug unless they obtain the permission from the developing company within the 20 years period. After that, other companies may develop and sell the drug but by observing certain rules and regulations especially following the compound and quality. And this is called general prescriptions. The main difference will be the cost of producing the compound will be much cheaper compared to brand-name prescriptions thus the consumers can obtain the compound for cheaper price but getting the same quality.

It is very interesting right? It was my first knowing about this after reading about it. I guess it will be helpful for those who visit pharmacy or drugstores always for prescription medicines. You could save some money!

Birthday Celebration Reflection

I was chit-chatting with a friend the other day, then suddenly we talked about birthday celebrations.

While chatting, there was this thought that crossed my mind. A lot of times we thought that birthdays are big days for people, or for ourselves. Then we always wish to have people to celebrate and spend time with us, hoping people to remember our "big days".

But then, i just suddenly think that, during our birthdays, shouldn't we be thinking about our mothers that gave birth to us during our birthdays years ago? Shouldn't we be celebrating with our mothers because she gave us life years ago after bearing us for 9 months or 7 months in her womb?

In a way, i think our birthdays are not so much about ourselves but more about someone that contributed so much in our lives that we often ignore? :) just a thought to share. hehe...

First Sunday Service

New semester started last week, was a busy and great week. I think I went out most of the nights throughout the week for fellowship and also meeting up with juniors. huhu...times flies and now I am in final year final semester already! feel so old. LOL. hehe...

Our church (Church of Praise Tronoh) had our first service for the semester. Although not much people were back, it was a great start for the semester! more to come ya. :)

New World Park Food Court, Penang

The food court is located at Swatow Lane, Penang. They offer a lot of nice and tasty food. It was my second time going there and i still trying new types of food!

the fried kueh tiao. the special thing is they have the "lak cheong" (marinated sausage). yeap, it tasted nice! but a bit small portion for RM3.50

If not mistaken is called "aptai", some mamak food. tasted quite and special. a bit sour and sweet. :)

hehe...i suddenly realise my blog is turning into a food blog already. hmmm...not quite what i had in mind but i think it's ok right? hehe...alright, will post up something different afterwards. :) hehe...


Car Accesories

The week before I came back to university, I was helping my mother to settle some stuff at home. After cleaning up the house and repairing some broken or missing parts at home, I proceeded to my mother’s car.

The car was 5 years old and it was still in good condition. Besides sending the car to the workshop for some service and check up, I just need to buy some accessories for the car. Besides going around town to survey for the prices and the availability of the accessories, I also tried to go online to survey.

Unfortunately, for my mother’s car, the accessories were not available online but I accidentally came to know that hyundai accessories are actually available online! That’s very good news for the Hyundai cars users. The purchase can be so convenient and sometimes economical if you know how to fix those accessories onto the car yourself. And I believe a lot of car models’ accessories can be purchased online as well.

I am truly amazed by the convenience and advancement the internet can offer. It is like we can get anything that we need from our homes through some clicks away. Besides, we can take our time and there’s no need to worry about customers that are waiting behind us anymore!

Sunshine Restaurant in Penang

During the trip to Penang, we went to a restaurant in Tanjung Bungah, it's called the Sunshine Restaurant. The restaurant is along the roadside to Batu Ferringhi.

There were 6 of us and we ordered 5 dishes. the dishes were quite big portion and they tasted nice!

the sea snails...hmm...they actually tasted quite nice...at first i thought were some fish....

my favourite, the fried chicken i think. dunno wat's the ingredient, but tasted a bit salty, not too salty but just nice. :)

this is my another favourite, fried fish with yam. super good! highly recommended. hehee...

Penang got too much food liao...eat also tired. hahahhaha......next time let's go again!
